Numerous developments have taken place since the publica tion of our Special Report SR -6 published in May 1990 , with the same title as this special report. It has been necessary to produce an entirely new report on the subject of political imprisonment , due to these important developments .

ADDENDUM - 16 APRIL 1991 The text of this report was completed on the 2 April 1991 and is correct as at that date . Since then over 100 prisoners have been released which will have an effect on statistics and lists of names .

Little information has come from the government . Until February 1990 it denied that there were any political prisoners , choosing to speak of people being imprisoned for ' crimes against the security of the state '. This phrase referred to those sentenced under the special security laws introduced to repress resistance , or those convicted of the common law offences of treason or sedition . In March 1989 the official figure for such prisoners was 374. These are principally people who have been involved in armed struggle or in organising underground political structures . The government also tried , largely unsuccessfully , to use these ' security' laws to imprison the leaders of legal political organisations - in particular there were major political trials of leaders of the United Democratic Front . In times of mass action the law , backed up by the armed might of the po lice and army , has been used against communities protesting about the oppressive conditions in which apartheid has forced the majority of South Africans to live . Tens of thousands of people engaged in mass protest and community resistance have been brought before the courts charged with public violence , incitement , arson Between September

were arrested on what the Minister of Law and Order described as 'unrest-related charges . Exactly how many were brought to court , sentenced and imprisoned is not known . The Minister of Justice stated in May 1989 that 1 117 people were charged with public violence between July 1987 and July 1988 , of whom 509 were convicted . Many of those named in this report were imprisoned during these years . The govern ment consistently refused to recognise such prisoners as political . It refused the International Committee of the Red Cross permission to visit them

It is now possible to identify over 1 800 people who were in prison in February 1990 , and the total is likely to have been 2 500 or more . This included more than 60 political prisoners amongst over 300 people on Death Row in Pretoria .

Resistance to apartheid and participation in the struggle for liberation takes many forms, which can be summarised in three broad categories : * Armed struggle - Involvement , directly or in a support capacity , in organised military structures . It includes active combat and armed action ; undergoing military training ; recruiting , harbouring and transporting com batants ; and transporting or possessing arms.

* Political organisation and mobilisation - This includes membership of illegal organisations and activities which further their aims, such as organising and building structures or promoting their ideas, and posses sion of banned literature . It includes resistance to military service in the

South African Defence Force

.

* Popular action - Mass action and community resistance

, or actions of organised workers . It involves action taken in protest over the living and working conditions imposed under apartheid and against individuals and institutions administering the system .

Out of the 1 835 political prisoners identified as at February 1990 , 414 ( 23 per cent) fell under the first two categories , and of those 380 ( 20 per cent of the total) had been involved in armed struggle as defined above .

( See Table I , where these two are grouped as ' Security Prisoners '.) There were also 125 soldiers of the Bophuthatswana army convicted of treason after a mutiny aimed at changing the administration of the bantustan . The remaining 1 296 (71 per cent ) were mostly imprisoned as a result of their participation in 'popular action ' as defined above , and sometimes referred to as 'unrest - related "). They include a small propor tion for whom there is too little information to categorise them .

THE COURTS AS A MEANS OF REPRESSION Political prisoners are only a small proportion of those who have faced the repressive might of the apartheid system . They have gone through a process in which the courts lent a superficially legal appearance to repression . They have been convicted under laws whose function has

been to preserve apartheid and prohibit opposition , and the legal proce dures themselves have been adapted to serve the interests of the state . Coercion and torture have been frequently used to procure evidence for use in trials . People who have refused to testify against others in political trials have faced prison sentences of up to five years . in this process is wide . Many of the laws created specifically repressive purposes were consolidated 1982 into the proscribe organisations Internal Security Act which contains powers prohibit gatherings and place restrictions and their objectives the

PARTIAL RELEASE OF POLITICAL PRISONERS In January 1985 , faced with mounting resistance and growing interna tional demands for the release of Nelson Mandela and other political prisoners , the government offered to release Mandela on condition that he renounce his commitment to the ANC's armed struggle . After De Klerk's speech , however , ministers indicated that an amnesty for political prisoners ' convicted of common law crimes ' could be negotia ted . The day before Mandela's release , De Klerk said that he had dis

cussed with him ' the position of persons involved in politically motivated crimes ,1 as well as those who have committed such crimes and who are now outside the country ', and that he had indicated that 'while this is a matter that should be dealt with in negotiations , exploratory discussions could take place in the meanwhile ' . Mandela's release was followed by that of only a few other prisoners . Only a few had been imprisoned solely because of actions made illegal by the banning of political organisations , and it was not possible to tell how many others had been imprisoned partly on account of such actions and had therefore had their sentences reduced . Of those known to have been released by this stage , 48 had been involved in armed struggle ; 16 had been convicted under ' security ' laws for activities other than those connected with armed struggle ; and 17 for ' unrest - related actions. Some had almost finished their sentences , while most had between one and three years still to serve

The government's objectives were underlined by statements from government ministers attempting to portray mass political protest as inherently violent and even as an activity related to armed struggle .

As part of the procedures , political prisoners have to complete a form giving details of their conviction (name of court , date of sentence , charges they were found guilty of, and sentence ) as well as why they regard their actions as political . Applications from prisoners who are members of political organisations then go to their organisation which

CONCLUSION The government's record over the release of political prisoners un derlines the urgency of the situation , with somewhere between 1 300 and 2 500 or even more political prisoners in South Africa's prisons. Knowledge about political imprisonment in South Africa is still masked by secrecy : enough is known , however , to make clear how much is still to be done . Of approximately

1 830 people known to have been in prison as political prisoners on 2 February 1990 , only 360 are known to have been released early . Almost 60 more have been reported released , but with too little detail to know if they came out of prison before they had com pleted their sentences . There are 16 who have been released as a result of appeals against their convictions or sentences . A further 130 are presumed to have come out because their sentences will have been

completed . Since February 1990 at least another 63 people have been imprisoned as a result of political trials . This would indicate that there are over 1 300 known political prisoners still being held , not to mention the hundred who have not been identified . Different categories of prisoners have been affected differently by the release programme . Over half of those identified as ' security' prisoners in February 1990 had been released early by the end of March 1991. This does not include 125 soldiers of the Bophuthatswana bantustan army

who were convicted of treason or terrorism and imprisoned in 1988 . Most of the political prisoners however fall into the category of 'popular action ' or ' unrest -related ', and of 1 296 identified prisoners in this

category in February 1990 , only 10 per cent are known to have been released early . ( Another 5 per cent have been reported released , but not necessarily early , and 9 per cent are presumed to have come out as their

sentences have expired .) Amongst the names of such prisoners are al most 240 about whom too little is known to tell if their sentences have ex pired . In addition , although every effort has been made to avoid mis

The case for their release as political prisoners is clear , and is un doubtedly covered by the agreed definition of a ' political offence '. The government's acceptance of the need to enter negotiations owes much to the sustained and courageous defiance of the mass of South Africa's population since the mid - 1970s , and in particular from 1984 , when most of these prisoners were sentenced . The fact that between 100 and 200 prisoners in this category have already been released indicates that there is no matter of principle at issue . In May 1990 the Minister of Justice acknowledged that : ' In certain circumstances a common law crime, yes, even murder , may be a political offence . ' Many of these prisoners are not members of political organisations and applications for their release may therefore take longer to process. The Government may wish to refer some of these cases to the advisory bodies , and claim that they cannot be handled under the first ' administra

tive ' phase of the programme - but it was only in February 1991 that it appointed the advisory structures whose work should have begun in Oc tober 1990. At the time of writing , the composition and functions of the advisory structures is far from clear .
