CENTURY DICTIONARY Trade-mark: A distinguishing mark or device adopted by a manufacturer, and impressed on his goods, labels, etc., to indicate the origin or manufacturer. T h e foundation of the protection afforded by the law to the owners of trade-marks is in the injustice done to one whose trade has acquired favor with the public if competitors are allowed, by colorable imitation of methods first adopted and continuously used by him for making his products recognizable, to induce intending purchasers to take their goods instead of his.
Foreword SO many cases develop, from time to time, involving encroachment upon our legal rights in trade-marks, catalog numbers, distinctive designs, and other indicia of the origin of our numerous products, as to m a k e expedient the issue of this record of cases in which our rights have been sustained and confirmed, either by adjudication, by default, or by confession. T h e purpose in view is one both of enlightenment and of warning; of enlightenment for those w h o m a y be ignorant of the law governing the rights in question, and of warning to those w h o hereafter, wittingly or unwittingly, m a y encroach upon our legal rights, that w e shall in every case vigorously seek to protect them. T o those w h o sincerely desire to obey the Golden Rule, and to understand what this implies in trademark matters, this record will prove enlightening and helpful. T R A D E - M A R K BENEFITS A T R A D E - M A R K belongs to the manufacturer or L -W\ merchant w h o originates it, and with whose goods -*- -*- it is identified, but its benefit accrues not only to him, but equally or more to his trade customers, the distributors, and to the public, the consumers. T h e benefit to the distributor consists in an assured market, in quicker sales, in satisfied customers w h o get what they k n o w and want, and in participation in the results of all advertising by the trade-mark owner. T h e benefit to the consumer consists in obtaining an article of established quality and repute, which is the same whenever and wherever purchased, of which he knows or m a y k n o w the fair current price, and which ensures him fair value for the price paid. T o an unusual degree all of these qualities inhere in the trade-mark " Y A L E , " and serve to benefit both the distributor and the consumer of Y A L E P R O D U C T S .
